The application is filed right after the strategy is approved. From then on, examination time is set by the INPI and varies with the office's backlog and the stages of the process. During the consultation, we share the current estimate.
Can I use the trademark while the application is under examination?
Yes. Use does not depend on the grant, and from filing the application can already be assigned or licensed. If there is an earlier third-party trademark, however, your use may be challenged, which is why the search comes before the application. We recommend using the ® symbol only after the grant.
What if a similar trademark already exists?
The search identifies this risk before filing. If there is a conflict, we suggest alternatives, such as adjusting the name, the classes or the description of products and services. If the application is already underway and a third party files an opposition, we prepare the response within the deadline.
What if the INPI rejects the application?
A rejection can be challenged through an administrative appeal within 60 days of the publication of the decision. We review the grounds and advise whether an appeal is recommended. Because it is outside the initial scope, the appeal is quoted separately and only filed with your approval.
How many classes do I need to register in?
It depends on what your company offers. The trademark is protected for the goods and services listed in the application, organized into 45 classes. A coffee shop that also sells coffee beans, for example, may need two. We define this with you at the strategy stage.
Can the fee change during the process?
Our fees are set when you hire us. INPI fees and additional acts, such as oppositions and appeals, are communicated in advance and follow the terms of the contract.
How long is the registration valid?
Ten years from the grant, renewable for equal, successive periods.
Does the registration protect the trademark in other countries?
No. INPI registration is valid in Brazil. For other countries, you can use the Madrid Protocol, which lets you designate more than 130 countries in a single international application, or file directly with each country's office. For the first five years, the international registration depends on the Brazilian application or registration.
Can I register as an individual?
Yes, as long as the trademark relates to an activity you actually and lawfully carry out. If you already have a company, we help you decide whether the owner should be you or the company.
Does having a CNPJ already protect my company's name?
Not as a trademark. Registration with the state commercial registry (Junta Comercial) protects the company name in your state. Exclusive use of the trademark nationwide comes from INPI registration.
