What a patent protects.

An invention patent protects a novel product or manufacturing process that involves an inventive step and possesses industrial application.

A utility model protects an object of practical use that has gained a new shape or arrangement resulting in functional improvement or manufacturing efficiency.

Pure scientific discoveries, mathematical formulas, commercial schemes, artistic works, and computer software per se are not patentable. For software, the correct legal instrument is software registration.

Can I patent software?

Software source code per se is protected via software registration. However, a technical hardware solution implemented through software may qualify as a patentable invention subject to detailed technical analysis.

I already presented my invention publicly. Can I still file?

Brazilian law provides a 12-month grace period for disclosures made by the inventor. It is essential to review the case immediately before that window closes.

Does a Brazilian patent protect my invention abroad?

No, patents are territorial. For international coverage, you can file via the Patent Cooperation Treaty (PCT) or directly in target countries within the 12-month Paris Convention priority window.

How long does examination take?

Examination time is established by the INPI and varies by technical field. Substantive examination must be formally requested within 36 months from filing.

Are there maintenance fees after grant?

Yes. Both pending applications and granted patents require annual maintenance fees (anuidades) paid to the INPI to remain in force.
